V.T.L. SECTION 511(1)(a) Aggravated Unlicensed Operation of a Motor Vehicle
Is one of the most common violations in the Desk Appearance Sections of the Criminal Court.
If at the time of the stop the Department of Motor Vehicle records reveal that your license was suspended for failure to pay a fine, assessment fee or failure to answer a traffic summons, you will be charged with a violation of V.T.L. SECTION 511(1)(a). The charging instrument against youmay state that DMV summonses have printed on them “if you do not answer this ticket by mail within (15) days, you license will be suspended.” The suspension occurs automatically (by computer) within four (4) weeks of your failure to answer. In some cases your license can be suspended for failure to pay child support.
A person is charged with aviolation of V.T.L. SECTION 511(1)(a) when he or she operates a motor vehicle upon a public highway while knowing or having reason to know that his license or privilege of operating a motor vehicle in the state of New York or privilege of obtaining a license to operate such motor vehicle issued by the commissioner of motor vehicles was suspended, revoked or withdrawn by the commissioner

§ 221.10. Criminal possession of marihuana in the fifth degree
A person is guilty of criminal possession of marihuana in the fifth degree when he knowingly and unlawfully possesses:
1. marihuana in a public place, as defined in section 240.00 of this chapter, and such marihuana is burning or open to public view; or
2. one or more preparations, compounds, mixtures or substances containing marihuana and the preparations, compounds, mixtures or substances are of an aggregate weight of more than twenty-five grams.
Criminal possession of marihuana in the fifth degree is a class B misdemeanor.
